11. Market Abuse and Prohibited Trading Practices

11.1

You will not arrange, execute, or place any Open Position or Order that contravenes any law or regulatory rules related to Market Abuse.

11.2

You must not use the Platform or our services in a fraudulent or abusive manner, or with the intention of exploiting errors, delays or malfunctions in prices, execution or systems. Prohibited practices may include, without limitation:

  • (a)

    exploiting clearly erroneous or delayed Quotes;

  • (b)

    exploiting technical or system errors;

  • (c)

    Latency Arbitrage, or any strategy relying primarily on exploiting delays in price updates, server latency or execution;

  • (d)

    coordinated trading between linked accounts, or collusion with other accounts, to exploit pricing or execution defects or to manipulate market prices;

  • (e)

    cross-hedging between internal accounts or with external companies to exploit bonus funds;

  • (f)

    market manipulation, including false reporting, misleading orders or price manipulation;

  • (g)

    insider trading or the misuse of non-public information;

  • (h)

    using accounts or systems primarily to obtain an undue benefit from a technical error or deficiency; and

  • (i)

    any other fraudulent conduct or deliberate manipulation of the Platform or trading systems.

11.3

Fast trading, Scalping, High-Frequency Trading, the use of Expert Advisors, bots or automated trading systems, or the fact that a trading strategy is profitable, does not in itself constitute evidence of abuse. These activities are a breach only where the method or strategy used is based, wholly or partly, on conduct prohibited under clause 11.2 or on the exploitation of a defect, delay or error in prices, execution or systems.

11.4

Exploiting pricing gaps by entering high-volume positions immediately before market close and exiting at market open constitutes an abuse of market mechanics.

11.5

Where we have reasonable grounds to suspect a prohibited practice, we may temporarily restrict trading or certain functions of your Trading Account while we carry out a review.

11.6

If the review confirms a prohibited practice, we may take appropriate and proportionate action, including: restricting or suspending trading; adjusting or cancelling transactions, and deducting profits, resulting directly from the prohibited conduct; closing Open Positions and/or Orders; terminating our relationship with you; and reporting the matter to the relevant authorities where required by law. We will notify you of the action taken as soon as practicable.

11.7

This does not prevent you from requesting withdrawal of the genuine funds remaining in your Trading Account, subject to KYC, AML and anti-fraud requirements and any legal or financial obligations due. Bonus funds, and profits derived from bonus abuse under clause 11.2(e), may be removed.
